The short version

1. Who this agreement is between

By installing or using PASA on iOS or iPadOS (the "App"), you ("You") agree to these Terms with the developer Weerayoot Yotasing, an independent developer based in Berlin, Germany ("we", "us"). If you do not agree, please do not install or continue using the App.

2. What PASA is

PASA is a German-language learning app. It generates lessons, vocabulary banks, minigames, and writing feedback using a combination of curated content and AI (Google's Gemini language model). It is intended as a study aid for German learners, not as a substitute for certified language instruction or professional tutoring.

3. AI-generated content disclaimer

Significant parts of PASA are generated by AI and may contain errors:

• Lesson grammar may be wrong, especially on edge cases (rare verbs, complex case endings, regional usage).
• Translations may miss nuance or idiom.
• Writing feedback may flag correct sentences as wrong, or miss real mistakes.
• Cultural / domain content (e.g. nursing terminology in the Pflege pack) may not reflect current best practice in your specific workplace.

You should not rely on PASA's output for any high-stakes purpose: certified exams, professional certifications, legal documents, medical communication with patients, or anything where being wrong has real consequences. Cross-check with a qualified human teacher, an authoritative reference (Duden, Goethe-Institut), or your professional supervisor.

4. Your responsibilities for content you enter

The AI features (Smart Journal, Story Weaver, Live Scenario, Visual Challenge, lesson generation) accept text you type. You are responsible for what you enter. Specifically:

• Do not paste private health information about identifiable patients.
• Do not paste legal documents, financial information, or anything subject to a confidentiality agreement.
• Do not paste content that is illegal, infringes someone's rights, or is intended to harass another person.

Text you enter is sent to Google's Gemini API to generate the response. See the Privacy Policy for details.

5. Subscriptions (PASA Plus)

PASA is free to install and use. PASA Plus is an optional paid subscription that removes most AI usage quotas and unlocks additional Max-mascot color themes.

Plans and pricing

Prices shown are EUR for the EU storefront. Prices in your local currency are determined by Apple's price tier matrix and may vary; you will see the exact price for your storefront in the App Store purchase prompt before you confirm.

Auto-renewal (this is Apple's standard required text)

• Payment will be charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the price displayed at the time of purchase, unless we changed the price and notified you in advance.
• You can manage and cancel your subscription by going to your account settings on the App Store after purchase: iOS Settings → tap your name → Subscriptions → PASA Plus → Cancel Subscription.
• No cancellation of the current subscription is allowed during the active period; cancelling stops the next renewal but you keep access until the period ends.
• Any unused portion of a free trial period (if offered), if any, will be forfeited when you purchase a subscription.

Refunds

Refunds are handled by Apple, not by us. If you believe you are entitled to a refund (accidental purchase, technical failure, etc.), request it through Apple at reportaproblem.apple.com. EU residents have additional consumer rights under EU consumer law that are not waived by these Terms.

6. Free tier limits and AI quotas

The free tier gives you full access to all curated Feature Pack lessons, the 10 minigames, the writing tools, and most UI features, with limited AI generation: a small number of generated lessons, minigame packs, writing reviews, and explanations per period. Quotas reset on a rolling window. Exact limits may change as we tune the app.

Subscribing to PASA Plus removes those quotas (subject to abuse-prevention rate limits at the proxy level). All app content remains available regardless of subscription.

7. Acceptable use

Do not use the App to:

• Reverse-engineer, decompile, or extract the proxy API tokens from the binary, in violation of Apple's Developer Program License Agreement.
• Drain AI quota by automating requests from outside the iOS app.
• Generate content that is illegal under German, EU, or your local law.
• Harass, threaten, or impersonate another person via shared content.

We may rate-limit, block, or refuse service to protect the platform from abuse.

8. Intellectual property

The App, including the Max mascot character, the curated lesson content, the minigame designs, the UI design, and the brand name "PASA", are owned by the developer and are protected by copyright. You receive a personal, non-transferable, non-sublicensable license to use the App on Apple devices you control, for personal, non-commercial purposes.

You retain ownership of content you create in PASA (your journal entries, your generated lessons). You grant us a limited license to process that content through the AI pipeline solely to provide the app's features back to you.

9. Third-party services

PASA uses the following third-party services. Their own terms and privacy practices apply:

• Google Gemini API — for AI generation. Google Terms, Google Cloud Privacy Notice.
• Cloudflare Workers — for the API proxy that holds the Gemini key. Cloudflare Terms.
• Apple App Store, iCloud, StoreKit — for distribution, sync, and payments. Apple Media Services Terms.

10. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted operation.

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to: loss of progress, lost streaks, missed reminders, incorrect translations, AI hallucinations, or damages arising from your reliance on AI-generated language content for high-stakes purposes (see Section 3).

Our total cumulative liability for any claim arising from or relating to the App will not exceed the amount you paid us for PASA Plus in the twelve months preceding the claim, or fifty Euros (€50), whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law (including, for EU consumers, statutory warranty and product-liability rights, and the rights afforded by mandatory consumer-protection law).

11. Apple as a beneficiary (App Store apps)

You acknowledge that these Terms are between you and us, not with Apple. Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you.

12. Termination

You may stop using the App and delete it at any time. We may suspend or terminate your access if you materially breach these Terms (notably Section 7). Termination does not refund any active subscription period; subscription cancellation is handled separately via the Apple ID controls described in Section 5.

13. Changes to these Terms

We may update these Terms. Substantive changes will update the "Last updated" date above. For material changes affecting your rights or the subscription, we will surface an in-app notice on next launch. Continuing to use PASA after a change means you accept the updated Terms.

14. Governing law and venue

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. The exclusive venue for disputes between business parties is Berlin, Germany. EU consumers retain the right to bring claims in their country of residence under mandatory consumer law and may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
